The race to regulate artificial intelligence is often framed as a contest of speed. And South Korea appears determined to win it. Next month, the country will begin enforcing a comprehensive AI law while other major economies hesitate or retrench.
인공지능을 규제하려는 경쟁적인 움직임은 속도전으로 종종 잘못 규정된다. 그리고 한국은 이 경쟁에서 꼭 승리하고자 하는 듯하다. 내달 한국은 다른 경제 선진국들이 실행을 망설이거나 축소하려고 하는 포괄적인 AI 법안을 실행할 계획이다.
That decision gives Seoul a form of leadership, but also raises an uncomfortable question: Is moving first an advantage when the rules themselves remain unsettled?
이러한 결정은 한국으로 하여금 일면 선두주자의 모양새를 갖추게 하는 동시에 불편한 의문 또한 제기하게 만든다. 법안 자체가 아직 불확실한 가운데 먼저 움직이는 것이 유리함으로 작용하는가?
The contrast from Europe is telling. The European Union passed the world’s first sweeping AI legislation, only to delay and dilute key provisions under pressure from industry and member states worried about falling behind global competitors. The US and China, meanwhile, continue to favor market momentum over formal constraint. Against that backdrop, South Korea’s decision to press ahead looks like a deliberate outlier strategy.
유럽과의 대비는 많은 것을 보여준다. 유럽연합은 세계 최초로 포괄적인 AI 법안을 통과시켰지만 글로벌 경쟁에서 뒤처질 것을 우려한 업계와 회원국들의 압박으로 주요 조항들은 결국 연기되거나 완화되었다. 반면 미국과 중국은 계속해서 형식적인 규제보다는 시장의 동력에 우선순위를 두고 있다. 이러한 분위기에서 법안실행을 강행하려는 한국의 결정은 의도적으로 예외가 되겠다는 전략처럼 보인다.
The AI framework act, set to take effect on Jan. 22, establishes a national AI committee, mandates a recurring three-year policy plan and introduces safety and transparency obligations for certain AI systems. Its stated aim is to create a legal foundation for trust. That goal is necessary since deepfakes, opaque algorithms and AI-driven deception are no longer abstract risks, but daily realities.
1월 22일 시행될 예정인 AI 기본법은 국가인공지능위원회를 설립하고 3년마다 계획을 세워 특정 인공지능 시스템에 안전성과 투명성을 도입하겠다는 내용이다. 신뢰를 구축하기 위한 법적 기반을 마련하겠다는 것을 목표로 내세운다. 딥페이크, 불투명한 알고리즘 그리고 AI를 이용한 사기가 더이상 막연한 위험이 아니라 일상에서 현실로 나타나고 있기에 그러한 목표는 필요하다.
The challenge, however, lies not in the goal, but in timing and calibration. Regulation that arrives before industry practices have stabilized must be precise. Otherwise, it risks hardening uncertainty rather than reducing it. In this respect, South Korea’s accelerated timetable could become a source of strain rather than reassurance.
그러나 목표 그 자체가 아니라 시기와 세밀함에 어려움이 놓여있다. 업계의 관행이 안정화되기 전에 시작되는 규제는 정밀해야 한다. 그렇지 않으면 불확실성을 감소시키는 것이 아니라 고착화시킬 위험이 있다. 이에 있어 한국이 앞당겨 법안을 실행하는 것은 확신보다는 부담의 원인이 될 수 있다.
That strain is most visible among startups. The enforcement decree that defines compliance is still being finalized, leaving firms only weeks to adjust. A recent survey of 101 AI startups found that 98 percent lack a practical response system.
부담은 스타트업 기업들에 있어 가장 눈에 띈다. 규정 준수의 잣대가 되는 시행령은 여전히 최종 검토단계로 기업들이 적응할 기간은 수주에 불과하다. 최근 101개 인공지능 스타트업을 상대로 실시한 조사에 따르면 98퍼센트가 실질적인 대응체계를 갖추지 못하고 있다고 한다.
Large technology groups can absorb regulatory shocks through scale and staffing. Startups cannot. For smaller firms, compliance costs translate directly into delayed hiring, suspended projects or abandoned markets.
기술분야 대기업들은 규모와 인력충원으로 규제의 충격을 흡수할 수 있지만 스타트업들은 그렇지 못하다. 중소기업에 있어 규정 준수 비용은 고용 연기, 프로젝트 중단 또는 시장 포기로 직접 이어진다.
There is also a geographic dimension. Industry groups warn that overly rigid rules create incentives to build and launch products elsewhere. Several South Korean AI startups have expanded operations in Japan, which has adopted a voluntary, industry-led governance model. Regulation does not eliminate innovation. It influences where it happens.
지리적인 측면도 있다. 업계는 지나치게 엄격한 규정이 국외에서 제품을 만들어 출시할 유인이 될 수 있다고 경고한다. 몇몇 한국 AI 스타트업은 자발적, 업계주도의 거버넌스 모델을 채택한 일본으로 사업을 확장해왔다. 규제로 인해 혁신이 일어나지 않는 것은 아니다. 다만 어디에서 혁신이 일어나는지에 영향을 주는 것이다.
The most sensitive issue is the proposed requirement to label AI-generated content. The policy logic is clear. Disclosure can help curb deepfakes and reduce misuse in areas such as finance, medicine and advertising. Transparency is a legitimate public interest.
가장 민감한 사항은 AI로 생성한 콘텐츠라는 표시를 의무화해야한다는 제안이다. 정책이 내세우는 논리는 명확하다. 딥페이크를 억제하고 금융, 의약 및 광고와 같은 분야에서 오용을 줄이는데 도움이 될 것이라는 것이다. 투명성은 정당한 공공의 이익이다.
The problem lies in interpretation. Content creators worry that a visible AI label, even on work shaped by extensive human input, could trigger consumer aversion and shrink the market.
문제는 해석에 있다. 콘텐츠 제작자들은 사람의 손이 많이 들어간 작업임에도 AI 표시가 보이는 것만으로 소비자들에게 거부감을 일으키고 시장을 위축시킬 수 있다고 우려한다.
They also point to unresolved ambiguity. Does disclosure mean a brief notice to users, or a watermark applied throughout text, images and video? Without clarity, firms are left to plan for the most restrictive reading.
그들은 여전히 애매모호한 부분이 많다는 점 또한 지적한다. 표시의무화는 사용자에게 간단한 고지를 하는 것을 뜻하는가 아니면 텍스트나 이미지, 동영상 전체에 워터마크를 적용하는 것을 말하는 것인가? 명확한 해석이 없다면 기업들은 가장 엄격한 기준을 상정하고 준비할 수 밖에 없다.
South Korea’s early move into AI regulation reflects a belief that trust is not a byproduct of innovation, but a prerequisite for it. That belief is defensible. What is less convincing is the assumption that speed alone delivers trust. Rules that are vague, unevenly burdensome or rushed into force can undermine confidence on both sides of the market.
한국이 인공지능 규제에 일찍 뛰어든 것은 신뢰가 혁신의 부산물이 아니라 전제조건이라는 믿음을 반영한다. 그 믿음은 옹호될 수 있다. 그러나 속도만으로 신뢰를 줄 수 있다는 가정은 그만큼 설득력있지는 않다. 모호하고 균등하지 않게 부담을 주거나 급하게 실행되는 법은 시장의 공급자와 수요자 모두에게 확신을 주기 어려울 수 있다.
The government’s current posture -- watching Europe while pressing ahead at home -- is unlikely to resolve that tension. What is needed instead is flexibility. Clearer definitions of high-impact AI, proportional treatment of creative content and sustained consultation with smaller firms would help align regulatory ambition with economic reality.
유럽의 상황을 관망하면서 국내에서는 규제를 서두르는 정부의 작금의 형세는 그러한 긴장상태를 해결하기 어려울 것이다. 그보다 필요한 것은 유연성이다. 영향이 큰 AI를 좀더 확실하게 규정하고, 창작 콘텐츠를 균형있게 다루며 중소기업과 지속적으로 협의해 나가는 것이 규제라는 큰 목표와 경제적인 현실성이 보조를 맞추는데 도움을 줄 수 있을 것이다.
The AI framework act does not need to be slowed to succeed. It needs to be made livable. In a field evolving as quickly as AI, credibility will come not from being first, but from showing that governance can adapt without losing its nerve.
인공지능 기본법이 속도를 늦춰야만 성공할 수 있는 것은 아니다. 지속될 수 있도록 만들어져야 한다. AI와 같이 빠르게 진화하는 분야에서 신뢰란 첫번째 주자라는 것에서 오는 것이 아니라 거버넌스가 위축되지 않고 적응해나갈 수 있다는 것을 보여주는데서 온다.
