A drunken thug in the U.K. who assaulted a woman so badly she now uses a wheelchair was allowed to walk free after authorities let the time limit on the case elapse.

Nikki Brewer, 18, was on her way home in Colchester, England, in April 2009 when a 31-year-old man attacked her, according to news sources.

CCTV footage shows the man grabbing her by her hair before punching her so hard that she was thrown into the air.

The assailant verbally abused Brewer and spat on her before walking away.

The man was arrested, but a series of delays to the proceedings meant the time limit on making a prosecution had passed, and the suspect was let go.

Both Essex Crown Prosecution Service (CPS) and the police are refusing to take responsibility for the failure to prosecute.

The Essex police spokesman stated that the suspect was arrested on a common assault claim.

However, after seeing the magnitude of Brewer’s injuries, the police decided to file for actual bodily harm, but Essex CPS did not accept the actual bodily harm claim.

By that time, it was too late to file for the original claim of common assault.

The CPS claim that they were never even given a file from the police and that they only gave advice on the matter.

“Nothing was ever logged in our system,” said a CPS spokeswoman. “We have no evidence this happened.”

Brewer, who currently works for the Multiple Sclerosis Resource Center, has been left with constant back pain and must often resort to a wheelchair to get around because of her pain.

She has also been diagnosed with defective degenerative disc and multi-level facet hypertrophy, a degenerative disease that affects her nerves, which doctors believe to have been brought on by the trauma injury.

“It is so frustrating and the law is silly,” she said.

“What was the point in making an arrest if there was no chance of prosecution?

“When I first complained to police, nothing happened and now I have run out of time to get justice.”

지난 2009년 4월 당시 18세였던 니키 브레워(21)는  친구들과 함께 귀가하던 중 한 취객과 마주쳤다. 취객은 그들에게 침을 뱉었고 이에 항의한 그녀를  무자비하게 폭행했다.

사건 당시 CCTV에는 취객이 그녀가 바닥에 쓰러지도록 주먹질을 한 뒤 그녀의 머리채를 잡아당겨 패대기치는 장면이 찍혀 있다.

이 같은 '주폭'으로 그녀는 뇌진탕, 타박상으로 고통받았을 뿐만 아니라 영구적인 허리 통증을 갖게 됐다.  

의사들은 이 폭행 사건의 후유증으로 신경세포가 서서히 기능을 잃어가는 퇴행성 질환까지 생겼다고 진단했다.  이에 그녀는 관절과 신경에 심한 고통을 느끼게 됐고 걸을 때의 고통을 줄이기 위해서는 휠체어의 도움을 받아야 한다.

에섹스 경찰은 BBC의 크라임와치에 목격자를 요청했고 지난 1월 31세 남성을 일반폭행죄로 체포했다.

그러나 이 사건은 경미 사건에 적용되는 6개월 기한 내에 치안 판사 법원에 접수되지 않았기 때문에 검찰까지 넘어가지 못했다.

상황이 이렇게까지 된 것은 경찰과 검찰이 적절한 조치를 취하는데 실패한 원인을 서로에게 돌리느라 바빴기 때문이다.

경찰은 브레워 사건에 대해 처음에는 일반 폭행죄를 적용하려 했으나 피해자의 부상이 심각한 것을 확인하고 일반 상해죄를 적용하려 했다. 그러나 검찰 측에서 브레워씨 사건이 일반 상해죄로 구속 영장을 발부하기에는 경미하다는 충고를 받았다고 했다.

에섹스 검찰(Essex Crown Prosecution Service) 측은 "우리 시스템에는 아무것도 등록된 것이 없다"며 사건이 접수된 것이 아니라 조언 요청만 받았다고 해명했다.

피해 여성은 "가해자가 같은 범죄를 또다른 사람에게 저지를 수 있다"며 "그런 사람이 활개치게 내버려 둔다는 것은 정말 유감"이라며 분노를 표했다. 그녀는 "법이 너무나 무능하다"며 억울함을 토로했다.
