Apple Inc. filed another suit in Germany, seeking to ban sales of Samsung Electronics  Co.'s smartphone models, including the Galaxy S Plus and the S II.

The suit targeting 10 smartphones was filed in the Dusseldorf Regional Court and is based on Apple design rights Apple in Europe, court spokesman Peter Schuetz said via phone today. Apple also started a separate suit against five Samsung tablet computer models related to a September ruling banning the Galaxy 10.1., he said. 



Last month, the Dusseldorf court said it is unlikely to grant an injunction against the Galaxy 10.1N and an appeals court also voiced doubts about the reach of Apple’s European Union design right that won the company the injunction against the Galaxy 10.1. The new suits aren’t filed under emergency proceedings and allow Apple a new procedure against both models.

After making headlines by initially winning the September injunction, the Cupertino, California-based Apple has faced setbacks in its battle against its closest rival in tablet computers. In addition to the German litigation, the iPad maker failed to convince an Australian court on Dec. 9 to reinstate a ban in that country. Both companies also filed patent suits against each other in several European countries.

A spokesman for Samsung, who declined to be identified, said the company had received both suits.

The Galaxy 10.1N is a modified version introduced after sales of the original 10.1 tablet were blocked.

The new cases are LG Dusseldorf, 14c O 293/11 and 14c O 294/11.

애플, 獨서 삼성전자 또 제소

애플이 독일에서 삼성전자 스마트폰 모델 10종에 대한 판매금지 소송을 추가했다.

뒤셀도르프 지방법원은 17일(현지시간) "이번 소송은 애플의 디자인을 침해했다는 것으로, 삼성전자의 갤럭시S와 갤럭시S Ⅱ 등의 유럽내 판매 금지를 목적으로 하고 있다"고 말했다.

애플은 이와 별도로 갤럭시 10.1 모델의 판매를 금지한 지난해 9월의 법원 결정과 관련해 삼성 태블릿 PC 5개 모델에 대한 소송도 제기했다.

앞서 뒤셀도르프 지방법원과 항소법원은 갤럭시 10.1의 경우와 달리 갤럭시 10.1N에 대한 판매금지 요청은 받아들여질 가능성이 낮다는 입장을 지난달에 밝힌 바 있다.

이번 애플의 추가 소송 제기는 지난달 삼성의 추가 소송에 대한 맞받아치기 성격이 강하며 법원에서 받아들여질 가능성은 낮은 것으로 관측된다.

삼성전자 역시 지난달 독일에서 애플을 상대로 3세대(3G) 통신 표준특허 2건과 상용 특허 2건을 침해했다고 추가 소송을 제기했다.

독일 법원은 삼성이 제기한 소송은 오는 3월2일, 애플이 제기한 소송은 오는 2월 17일 각각 판결을 내릴 예정이다. 애플은 지난해 9월 독일에서 제기한 갤럭시 상대 소송에서는 삼성전자를 이겼지만, 태블릿 컴퓨터를 대상으로 한 소송은 졌고 이후 호주에서 진행된 소송에서도 패소했다.
