The government will push for various policies to promote welfare of artists normally struggling to make ends meet as related laws are set to come into force this month, the culture ministry said Tuesday.

A controversial law aimed at protecting occupational rights of artists and promoting their creative activities will go into effect on Nov. 18 along with two enforcement ordinances that passed the Cabinet Tuesday, the ministry said.

Under the laws, the government has earmarked 7 billion won ($6.4 million) from next year‘s budget to run a job training program for aspiring artists and a program for supporting creative activities by professional artists, the ministry said. A total of 2,400 people will benefit from the programs, starting early next year, it added.

South Korea’s population of artists, including movie and performing arts staff and school teachers, was estimated at 540,000, according to 2008 data by the Korean Employment Information Service affiliated with the labor ministry.

The laws would also allow the government to set up a welfare foundation for artists this month and employed artists to join the industrial accident compensation insurance, the ministry said.

Legislated a year ago, the government-led law on artists‘ welfare has sparked controversy due to its obscure definition of artists and failure to protect artists with medical and three other major government-led insurance programs.

Ministry officials, however, downplayed mounting criticisms about the new law, calling it a small but important first step.

“We know there are concerns about the law’s failure to give artists the benefits of four major insurance programs and draw a big budget. But it is the starting point of reflecting the contribution artists have made to the society in a law,” Kim Jae-won, in charge of arts policy at the ministry, told reporters.

He expressed hope that the law will be complemented in the future to better support lives of economically unstable artists. (Yonhap News)

‘예술인복지법’ 전격 시행! 그러나..

‘예술인 복지법’이 예술계의 우려와 기대가 교차하는 가운데 18일부터 시행된다.

문화체육관광부는 6일 ‘예술인 복지법 시행령 제정안’이 이날 국무회의를 통과함에 따라 한국예술인복지재단이 출범하고 산재보험 가입 등 여러 가지 예술인 복지 지원 정책이 본격 추진된다고 밝혔다.

예술인 복지법은 예술인의 직업적 권리와 권리를 법으로 보호하고 창작활동을 증진하고자 지난해 11월 제정됐다. 하지만 입법 과정에서 4대 보험 혜택이 빠진 채 산재 보험 규정만 남은데다 예술인의 기준도 논란을 일으켰다.

또 운영기관인 예술인복지재단을 놓고서도 이해관계가 첨예하게 대립해 실무 부처인 문화부는 지난해 9월 공청회까지 열어 각계 의견을 수렴했다. 공청회 참석자들은 대부분 법안 마련 취지에 대해 공감했지만 예술인의 기준과 법안의 실효성 등에서는 의견이 나뉘었다.

문화부는 논란이 된 ‘예술인의 정의’와 관련해 ▲공표된 예술활동 실적 ▲예술활동 수입 ▲저작권(저작인접권) 등록 실적 ▲국고•지방비 등의 보조를 받은 예술 활동 실적 등 4가지 요건을 예술인 활동 증명 기준으로 제시했다. 이 가운데 하나만 충족해도 ‘예술인’이 될 수 있으며 요건에 해당하지 않으면 예술인복지재단의 별도 심의를 통해 증명할 수 있도록 했다.

예술인복지법 시행과 관련한 내년 예산은 70억원 배정됐다. 총 2천400명(취업 지원 교육 프로그램 1천500명, 사회공헌과 연계한 창작준비금 지원 900명)에게 혜택이 돌아간다.

문화부는 “복지혜택을 받을 수 있는 법 대상으로서 예술인의 범위는 폭넓게 인정하되, 실제 복지사업 대상은 한정된 예산을 감안해 지원이 꼭 필요한 예술인이 혜택을 받도록 공정하고 엄격한 기준을 마련해 지원 대상을 선정할 것”이라고 밝혔다.

이날 국무회의에서 ‘산업재해 보상보험법 시행령 개정안’도 함께 통과함에 따라 예술인도 산재보험에 가입할 수 있게 됐다. ‘예술인 복지법에 따른 예술인으로서 예술활동의 대가로 보수를 받는 계약을 체결하고 활동하는 사람’이 대상이다.

아울러 이달 하순께 예술인복지재단도 설립된다. 이 재단은 사회보장 확대 지원, 예술인의 직업 안정과 고용 창출, 예술인 복지 금고의 관리와 운영 등 다양한 복지 증진 사업을 맡는다.

또 예술계의 근로환경 개선을 위해 표준계약서 양식이 개발돼 보급된다. 예술인의 경력관리에 도움을 주고자 예술인의 활동과 실적을 체계적으로 축적해 관리하는 예술인경력정보시스템도 구축돼 운영된다.

문화부는 “예술인 복지법이 실효적으로 정착될 수 있도록 노력해 나갈 계획”이라며 “예술인 복지법 시행이 예술인들의 사회•경제적 지위 향상과 예술인의 생활 안정에 기여할 수 있을 것으로 기대한다”고 밝혔다.
