Samsung Electronics won its appeal against Apple’s temporary ban on its sales of tablet PCs in Australia, increasing the possibility of a turnaround in the ongoing patent battle between the two.

The Federation Court of Australia on Wednesday overturned its October decision to ban the sales of Samsung’s Galaxy Tab 10.1 in the country. News reports said Apple plans to take the case to the High Court.

The three-member judicial panel granted victory to Samsung, enabling the Suwon-based firm to win a patent war against Apple involving two user interface-related patents ― heuristics and multi-touch browsing. Samsung, however, will not be permitted to sell the device until Friday afternoon.

“We welcome the Australian court’s decision,” said a Samsung official. “This is a case which corrected Apple’s attempt to apply intellectual property rights in such a general manner and Samsung’s fight over the issue is expected to continue.”

Samsung is projected to begin selling the wireless gadget by mid-December, being able to take orders for the holiday season starting next month. But the sales date is likely to change if Apple decides to appeal to the High Court.

Speculation has it that the two global firms may unexpectedly strike a deal ― such as a cross-license ― regarding the patent battle. But Samsung officials play down the possibility of a dramatic compromise.

Shin Jong-kyun, president of the mobile communications business at Samsung, told reporters this week that there is “no possibility to come to an agreement concerning intellectual property within this year.”

“We will continue to take firm counteractions,” he said.

Earlier in October, an Australian court granted Apple’s request for an injunction, prohibiting the sale of the Galaxy Tab 10.1, which invoked Samsung to press immediate legal options.

Apple also filed another preliminary injunction request in Germany this week to prohibit sales of Samsung’s Galaxy Tab 10.1N, another version of the firm’s tablet PC series.

Samsung had released a model called Galaxy Tab 10.1N, which includes different features from its Galaxy Tab 10.1, in Germany after it was banned from selling the tablet PC in the country earlier this year. Samsung’s Galaxy Tab 7.7, released for the first time at the global electronics trade show IFA in Berlin, was also removed from its display stand in September.

The two rivals, who also are business partners, are currently engaged in about 30 different patent battles in nine countries.

삼성, 호주 애플 소송전 2심서 승소

1심 뒤집혀…애플 상고방침으로 본격 판매 속단 어려워
삼성 "다음달 중순부터 판매"

삼성전자가 최신 태블릿 PC 갤럭시 탭 10.1 의 호주 내 판매를 둘러싼 애플과의 소송전에서 1심의 패배를 뒤집고 항소심에서 승리했다.

하지만 애플 측이 항소심에 불복해 상고하겠다는 뜻을 밝혀 갤럭시탭 10.1의 본격적인 판매를 속단하기는 어려운 상황이다.

호주 연방법원 린제이 그램 포스터 판사는 30일(현지시간) 갤럭시 탭 10.1 판매를 금지한 1심의 가처분 결정을 뒤집고 "갤럭시 탭 10.1 판매 금지는 이유가 없다"고 판결했다.

이날 항소심에서 판사 3명 전원이 삼성전자의 손을 들어줬다.

이번 결정으로 삼성전자는 크리스마스 소비지출 성수기를 앞두고 호주 시장에서 갤럭시 탭 10.1을 본격 판매할 수 있는 길이 열렸고, 현재 계류중인 애플과의 스마트폰 특허 전쟁에서 유리한 고지를 점하게 됐다.

그러나 이번 결정은 다음달 2일 오후 4시 이후부터 효력을 발휘하게 돼 있어 그 사이 애플이 어떤 대응을 할지 주목된다.

호주 법원은 이날 애플 측이 갤럭시 탭 10.1 판매 허용 결정과 관련, 대응방안을 마련할 시간을 달라는 요구를 수용했다. 

애플은 "이번 결정이 연방 대법원에서 뒤집히기를 기대한다"고 말해 상고 방침을 분명히했다.

포스터 판사는 "애플이 갤럭시 탭 10.1 판매금지를 연장하고자 한다면 대법원에 이 문제를 가져갈 수 있다"고 밝혔다.

이에 따라 이번 양측의 다툼은 대법원에서 최종 결론이 날 가능성이 커졌다.
앞서 지난달 13일 호주 1심 법원은 특허권 침해 등을 이유로 갤럭시 탭 10.1에 대해 판매금지 가처분 결정을 내렸고, 삼성전자에 대해 최종 판결이 내려질 때까지 제품 판매나 판촉 활동을 하지 말도록 했다.

삼성전자는 이에 불복해 곧바로 항소했다.

삼성전자 호주판매법인(법인장 윤승로)은 이날 "서울에서 갤럭시 탭 10.1를 수입한 뒤 호주 주요 유통업체들과 의논을 통해 본격적인 시판에 나설 것"이라며  "문제가 없다면 본격시판 시점은 다음달 중순쯤 될 것"이라고 말했다.
한편 삼성전자는 아이폰과 아이패드2 제품이 자사의 3G(제3세대 이동통신) 기술 특허를 침해했다며 호주 법원에 애플을 상대로 판매금지 가처분 소송을 제기한 상태 다.
